Waiver, Indemnity and Release of

In consideration of
participating in the rental use of our skate and/or bicycle equipment. I represent that I understand the nature of
using this equipment and that I am
qualified, in good health, and in proper physical condition to participate. I
acknowledge that if I believe event conditions are unsafe, I will immediately
discontinue participation.
I fully understand that
this activity involves risks of serious bodily injury, including permanent
disability, paralysis and death, which may be caused by the renter’s own
actions, or inactions, those of others participating, the conditions, or the
negligence of the renter named below; and that there may be other risks either
not known or not readily foreseeable at this time; and I fully accept and
assume all such risks and all responsibility for losses, costs, and damages I
incur as a result of my participation.
I hereby release,
discharge, and covenant not to sue Milwaukee Bike & Skate Rental a division
of the Carol Company, or any of its respective administrators, directors,
agents, officers, volunteers, employees, other participants, any sponsors,
advertisers, and, if applicable, owners and lessees of premises on which the activity
takes place, from all liability, claims, demands, losses, or damages on my
account caused or alleged to be caused in whole or in part by the negligence of
the renter(s) or otherwise, including negligent rescue operations.
* ONLY
INDIVIDUALS 16 YEARS OR OLDER CAN STEER AND BRAKE THE SURREY BIKE.
* PEDESTRIANS ALWAYS
HAVE THE RIGHT OF WAY.
* I WILL SUPERVISE ANY PERSONS UNDER AGE 18 THAT POSSESS EQUIPMENT THAT I HAVE
RENTED.
* INDIVIDUALS UNDER 18 MUST WEAR WRIST GUARDS WHEN SKATING.
* NO
ALCOHOLIC BEVERAGES ALLOWED WHILE RENTING EQUIPMENT.
* I WILL ONLY USE
EQUIPMENT ON DESIGNATED TRAILS AND FLAT SURFACES. (NO HILLS OR PUBLIC STREETS).
* I WILL OBEY TRAFFIC LAWS, AND LOOK OUT FOR MY OWN SAFETY AND THE SAFETY OF OTHERS.
* I WILL BE RESPONSIBLE FOR ALL
DAMAGE DUE TO CARELESSNESS OR INTENTIONAL ACTS.
* I WILL PAY ALL OF THE RENTAL FEES.
I have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK,
AND INDEMNITY AGREEMENT. I understand
that I have given up substantial rights by signing it and have signed it freely
and without any inducement or assurance of any nature and intend it be a
complete and unconditional release of all liability to the greatest extend
allowed by law and agree that if any portion of this agreement is held to be
invalid the balance, notwithstanding, shall continue in full force.

BASED ON 30 MINUTE RENTALS. PLEASE WATCH YOUR TIME. WE RESERVE THE RIGHT TO
CHARGE FOR ADDITIONAL TIME, IF WARRANTED.
